By execution of this Consent Form, the ECHO Partner hereby authorizes in connection with the Reach Mobile ‘ECHO Partner Program, the creation of a co-branded website and mobile application, including for each of Android and iOS (herein after referred to as the Site), such that the Reach Mobile and the ECHO Partner can market, promote, refer and sell the Mobile Service to Subscribers within the Territory, in a way which is co-branded with Reach Mobile Services.

Such Site shall be owned and operated by Reach Mobile in connection with the Reach Mobile ‘ECHO Partner Program’ Agreement (the “Agreement”) agreed by the ECHO Partner.

ECHO Partner hereby authorizes Reach Mobile, to identify ECHO Partner on the Site, and to use and display ECHO Partner’s trade name, trademarks, service marks, and logos for purposes of creating the Site and  to use the trademark(s), tradenames(s) and corresponding logos of the ECHO Partner, including in conjunction with the sale, commercialization, and/or marketing of certain telecommunications services under the trademark as detailed in this Consent Form.

Reach Mobile is the carrier of record, and the relationship with the Subscriber shall be between Reach Mobile and Subscriber. Reach Mobile, and not ECHO Partner, is selling the Subscription to the Mobile Service to each Subscriber, and Subscribers shall pay Reach Mobile, and not the ECHO Partner. 

Notwithstanding anything contained herein or in the Reach Mobile ‘ECHO Partner Program Agreement, Reach Mobile retains a right to prominently include the name or logo of Reach Mobile (on standalone basis or in combination with ECHO Partner’s Trademark as part of the Mobile Services,  the name of the Site, in the URL, app link, or the related domain name, sub-domains, app icon, favicon, etc. The Site may include attribution to both ECHO Partner and Reach Mobile on every page, where such attribution shall be the name of the ECHO Partner powered by Reach Mobile’ or the name of the ECHO Partner in collaboration with Reach Mobile’ ’ or similar language agreed to by the parties.

Trademarks and logos to be used may be separately shared by the ECHO Partner, with Reach Mobile.
