Endorsement and Advertising Guidelines

For the ECHO Partner Program

  1. The ECHO Partner agree to comply with all applicable Federal Trade Commission ("FTC") guidelines and regulations pertaining to endorsements and testimonials in advertising, including but not limited to the requirements set forth in 16 CFR Part 255. 

  2. The ECHO Partner agrees to provide clear and conspicuous disclosure of the material connection between the ECHO Partner and Tube, Inc ("Reach Mobile ") in all promotional content. This disclosure must be made in a manner that is easily understandable by the audience and must be placed in close proximity to any endorsement or testimonial. Acceptable methods of disclosure include, but are not limited to: 

    • Using terms such as “[Name of the ECHO Partner] in collaboration with Reach Mobile” or “[Name of the ECHO Partner powered by Reach Mobile”. 

    • The ECHO Partner shall always reference Reach Mobile as mentioned above, whenever the reference to the mobile services is made. For clarity, ECHO Partner’s brand name or logos shall never be used without reference to ‘Reach Mobile’ in connection with the mobile services in any posts, advertisements, promotions or marketing materials. 

    • Clearly state the nature of the endorsement or promotional relationship within the post itself. 

  3. The ECHO Partner agrees to be truthful and accurate in all endorsements and testimonials regarding Reach Mobile and its services. Any claims made about the services must be substantiated and not misleading. The ECHO Partner agrees not to make any exaggerated or unsubstantiated claims that could be considered deceptive or fraudulent. 

  4. When endorsing or promoting Reach Mobile on social media or other online platforms, the ECHO Partner must (a) follow the specific disclosure guidelines as may be shared by Reach Mobile from time to time, as well as FTC regulations; (b) ensure that all posts, stories, and other forms of content are marked as sponsored or legend as mentioned above or include the required disclosures and (c) not use deceptive practices, including but not limited to, failing to disclose the material connection between the ECHO Partner and Reach Mobile. 

  5. Reach Mobile reserves the right to request modifications to all endorsement and promotional content to ensure compliance with FTC guidelines and the terms of this Agreement. 

  6. The ECHO Partner acknowledges that they are responsible for ensuring their endorsements and promotional activities comply with all applicable laws and regulations. The ECHO Partner agrees to indemnify and hold harmless Reach Mobile from any claims, damages, or liabilities arising out of a failure to comply with FTC guidelines or other applicable laws.
